46. (1) The Council may appoint a committee for any
such general or special purpose as in the opinion of the
Council would be better regulated and managed by means of
committee, and may delegate to a committee so appointed, with
or without restrictions or conditions, as they think fit,
any functions exercised by the Council either with respect to
the whole or a part of the area of the Municipality, except
the power of levying, or issuing a precept for, a rate, or of
borrowing money.
(2) The number of members of
committee appointed
under this section, their terms of office, and the area, if
any, within which the committee is to exercise its authority,
shall be fixed by the Council,
(3) A committee appointed under this section (other than
a committee for regulating and controlling the finance of the
Council or of any area) may include persons who are not
members of the Council:
Provided that at least two-thirds of the members of
every committee shall be members of the Council.
(4)
Every member of a committee appointed under this
section who at the time of his appointment was a member of the
Council shall, upon ceasing to be a member of the Council,
also osase to be a member of the camittee:
Provided that for the purposes of this section a member
of the Council shall not be deemed to have ceased by reason of
retirement to be a member of the Council, if he has been
re-elected a member thereof not later than the day of his
retirement.
(5) Nothing in this section shall authorize the
appointment of a committee for any purpose for which the Council
